Michael Avenatti filed the defamation suit against Trump in 2018, when he was Daniels’ lawyer. Daniels, whose real name is Stephanie Clifford, said in a statement Tuesday that Avenatti had filed the suit “without my permission and against my wishes.”
Avenatti was found guilty this year of wire fraud and identity theft for wrongly pocketing about $300,000 of the $800,000 advance Daniels was paid for her book, “Full Disclosure.”
He was also convicted in 2020 of extortion, wire fraud and transmission of interstate communications with intent to extort in connection with threats he made against Nike, the sports equipment and apparel giant. Last year, a federal judge sentenced him to 2½ years behind bars for those crimes.“

Costello: Essentially that’s correct
Hannity: Did he tell you specifically that he did this on his own without Donald Trump’s knowledge?
Costello: Here is what he did. He said he did this on his own. He didn’t mention Donald Trump’s name. He said there was a problem. Stormy Daniels lawyer or representative got in touch with him. He worked out a negotiated deal, got an NDA, a non disclosure agreement, $130,000. I asked him, I said, is that Donald Trump’s money?”
Cohen: No
Costello:Did you get that from any Trump organization?
Cohen: NO
Costello: Is that your money? Did you take it out of one of your accounts?
Cohen: NO
Costello: Where did you get the money from?
Cohen: I took out a HELOC loan
Costello: Why would you do that?
Cohen: Because I wanted everything to be secret. I didn’t want my own wife to know about this…
Costello continuing on with the story:…once he (Cohen) told us he was suicidal and he needed an escape route, an escape hatch, was the phrase he used, he said, I need to know what my options are. Can I get a pardon? Can I get a commutation? Can I get cooperation?
I told him a pardon and commutation were out of the question and he had not even been charged with a crime. So let’s talk abut cooperation.
I said Michael, no offense intended but you are a bump in the road to the US Attorney’s Office. They are clearly going after Donald Trump. You are standing in the way and they are willing to roll over you to make you decide that you have to flip, to cooperate with the government in order to save yourself. You can either cooperate and give them a little if you don’t have important information, and that means your sentence would be reduced. Or if you have something big, and in this case it was clear that the government wanted Donald Trump, then you would get a non-prosecution agreement.
Costello: Do you have anything on Donald Trump. Anything?
Cohen: NO
Costello: I said, think about this, don’t answer it quickly…
